We assist foreign and Brazilian companies in the register of foreign capital with the Brazilian Central Bank, via the RDE system (“Registro Declaratório Eletrônico”, “Investimento Externo Direto” [“IED”] and “Registro de Operação Financeira” [“ROF”]).
The foreign direct investments are registered on the “IED” module (payment of capital, acquisition of capital participation, corporate reorganization, etc) and the financial operations, such as loan, import financing, leasing, etc. are registered on the “ROF” module.
In this scenery, our assistance includes also the structuring of international operations with assignment and/or debt remission, simultaneous exchange contracts, etc.
With broad experience in the declaratory registers with the Central Bank, we are able to assist either our clients during their incorporation in Brazil or those who are already on the market.
We are also able to make a review of registers made with the Central Bank, since many companies that have been established in the country for some time are not aware of periodic obligations foreseen by the law and are facing the risk of penalties applied by the Central Bank for lack of register or irregularity in declared information.
If the client is already being sued by the Central Bank, we are able defend the company to this entity, in first and second grades (“Conselho de Recursos do Sistema Financeiro Nacional”).
